Maxx Group and its subsidiaries (“YuMe Toys”, “Licensing Matters Global”, “Maxx Marketing” “we,” “our,” or “us”) are committed to providing a fun, entertaining, and safe experience for our customers. This Privacy Policy (“Privacy Policy”) describes how we collect, use, disclose and otherwise process personal information in connection with the Yumetoys.comwebsite, the YuMe social channels and the following affiliate websites managed by Maxx Group maxx-marketing.com, maxxgroupglobal.com  and licensingmattersglobal.com (collectively the “Sites”). This Privacy Policy applies whether you access the Sites through a personal computer, mobile device, or any other means. This Privacy Policy is not, however, a contract and does not create any legal rights or obligations.

We are committed to the protection of consumer privacy. Maxx Group has created this privacy policy in order to demonstrate its commitment to the privacy and protection of your personal information related to our Sites or Apps. To better protect your privacy, Maxx Group provides this notice explaining our information practices and the choices you can make about the way your information is collected and used.

Personal information you give us: We collect personal information that you provide to us on our Sites, such as when you:

  • provide your email address to sign up for one of our newsletters (“Newsletters”),
  • provide your contact information and submission in a survey, sweepstakes, contest, or other promotion,
  • provide us information about your interests, how to contact you and your feedback when you sign up for our Newsletters

Maxx Group may collect personal information like name, telephone or cell phone number, email address, date of birth, home address, and details regarding your mode of payment, e.g., credit/debit card or account information, when you access certain areas of the Site that require registration or payment for products and services, or if you require more information about those services. Under certain laws, such as the Children’s Online Privacy Protection Act (COPPA), personal information may also include video, photos, voice, geo-location or GPS location data, and persistent identifiers like third-party persistent cookies, IP addresses that may be used to recognize users over time, and across different web sites or online services.

While we take all reasonable steps to protect the privacy of our website visitors, we cannot promise that the current limitations of our online applications programming will address every browser setting or honor every personal browser preference. In particular, we have not implemented the necessary program changes to honor “Do Not Track” or “DNT” browser signals. Further, our online service providers or business partners may implement technologies that allow for the collection of personally identifiable information over time and across websites. We recommend that you review each privacy policy posted on the websites that you visit to better understand privacy practices on those websites.

At other times, Maxx Group may collect information that cannot be used to directly identify you, such as browser access times, referring URLs, dynamic IP addresses and similar non-personally identifiable information. For example, we may collect and aggregate non-personal information about you and other customers who visit certain areas of our Site. Aggregated information will not contain any information that can be linked directly back to you.

Purchase and payment information: your purchase is managed through third-party payment processors (such as PayPal or Amazon Pay). Please refer to the third-party purchase and payment providers websites directly for their Privacy Policy on any personal information submitted at purchase point. We do not control, are not responsible for, and make no representations whatsoever regarding such other websites or stores, or the products and services offered by or through such third-party websites or stores, even those with which Maxx Group may have an affiliation. If you decide to access such third-party websites or stores, you do so at your own risk. You should carefully review the privacy policy and terms of any such website or store.

Social media channels: The Sites may also include YouTube videos, social media features, such as the Facebook Like button, and widgets, such as the “Share This” button or interactive mini-programs that run on the Sites. Your interactions with these features are also governed by the privacy policy of the company providing it.

 

 

Personal information we collect automatically: We and our third-party providers automatically collect certain types of personal information when you visit the Sites, including the name of the domain and host from which you access the Internet; the IP address of the computer you are using and the browser and operating system you are using; the date and time you access the Sites; the Internet address of the website from which you linked to the Sites; any search terms you used to find the Sites; your device identifiers and mobile and network information; your general geographic location based on your IP address or more precise location when accessing our Sites through a mobile device; and your actions on the Sites. How Maxx Group Collects Personal Information (Cookies)

Maxx Group may use any number of tools to collect information about you, your device access points, your use of our Apps, and the web browser that you use to connect to our Site. For example, first party “cookies” are tiny text files that we place on your device’s hard drive when you visit our Site. We may use cookies to personalize your Site experience. Children and Data Collection

Our Sites are not directed at children under the age of 13, and we do not knowingly collect personal information directly from children under the age of 13 or from other websites or services directed at children under the age of 13. Consistent with the Federal Children’s Online Privacy Protection Act of 1998 and its rules (“COPPA”), Maxx Group will not knowingly request or collect personal information from any child under age 13 without obtaining the required parental consent.

If you are a parent or legal guardian and sign up to our Newsletter for or on behalf of your child, naming your child as the Newsletter recipient, you agree that Maxx Group may collect, store, use and process your child’s personal information for the purposes described above and in accordance with this Privacy Policy. If we learn that a user under 13 years of age has submitted personal information through or using one of the Sites without his or her parent or legal guardian’s consent, we will take reasonable measures to obtain consent by contacting the child’s parent or legal guardian if possible and shall, if consent cannot be or is not obtained, take reasonable measures to delete such information from our databases and not use such information for any purpose (except where necessary to protect the safety of the child or otherwise as required by law).

How You May Access and Change the Information that Maxx Group Collects

You may request to view your personal information, or delete or modify incorrect parts thereof by emailing us at info@yumetoys.com. Please note that we may be required to decline your deletion request, or only honor your deletion request after a certain period of time, for business or legal reasons. In response to a deletion request, we may delete the personal information or deidentify/aggregate the personal information so that it can no longer be reasonably connected to you. When we delete any information, it will be deleted from the active database, but may remain in our archives. We reserve the right and may be required by law to verify the identity of any person making a request to access, modify or delete personal information; provided, however, that we will have no liability of any kind resulting from false or erroneous requests by you or any change or deletion made in accordance with your request.

Where you provide your email address to Maxx Group through the Sites, we may send you commercial emails in order to deliver the Newsletter, to provide you with more information about available products you have purchased, and to provide you with updates, special offers, and other information, including but not limited to Site updates. You may unsubscribe from these commercial emails or from receiving our Newsletter at any time by clicking on the “unsubscribe” link included in any email or by contacting YuMe Toys via email at info@yumetoys.com or the email provided. If you request to opt out of promotional communications, please note that we may continue to send you non-promotional communications via telephone or email, such as communications related to any business we may have with you or other transactional emails.

How You May Opt-Out

If consent has been given, Maxx Group may also send you marketing emails or contact you with details of other products or services we think may be of interest to you. Following consent to receive marketing communications, you may opt out at any point. You have a right at any time to stop us from contacting you for marketing purposes.

How You May Have Your Information Erased

If you have subscribed to our marketing database but are inactive (do not open or click on a link within our email communications) for 152 days or longer, we will automatically remove you from the database.
